Can I own a property in Mexico as a foreigner?
Something you need to know about buying in Baja, which makes the process a bit different from anywhere else is that you have to buy through a Fideicomiso, which is a real estate trust that's held by a Mexican bank of your preference. A trust is valid for 50 years and it's renewable once that term is over, you can also inherit or transfer this in case you want to sell the property in the future. In case you were to buy from a foreigner you have the choice of having a trust transfer for the rest of the years of that initial trust, or you can choose to re-start the 50 years.
How Long is the process?
The process of purchasing a home usually takes about 90 days to close, because it's mostly paperwork that gets filed through a closing company, a notary, and the bank to set it all up. Other than this, everything else is pretty similar to the US process, offer presented, then accepted, good faith deposit through a 3rd party escrow and that's it.
How can I select a real estate agent to represent me?
Of course, choosing a trustworthy real estate agent that helps guide you along this process is fundamental, my recommendation is to select a well-known agent, who lives in the area and is part of the community. You must also check if the agent is part of a brokerage, it is licensed and experienced as well. Baja California Sur is one of the few states in Mexico with an MLS Association which is an extra benefit since you can choose to work with an agent affiliated with the MLS and they can show you not only their listings but everything that is currently on the market.
